Terms & Conditions 

These terms and conditions (“Terms”) apply to all services provide by Response Science Limited (trading as “The Gold Company”, “TheGoldCompany.co.uk”,or such other brand we may use from time to time) a limited company registered in England and Wales under company number 09287462 at 71-75 Shelton Street, Covent Garden, London, England, WC2H 9JQ  (also refereed to in these terms as “we”, “us” or “our”).


Services

 

We will offer to purchase from you any scrap gold or precious metal. We pay a percentage of the gold price based on the volume. By posting goods to us, you agree to our terms regardless of whether you have completed the declaration included in your pack. You must be at least 18 years of age to use our service.  You warrant that you are the legal owner of the items sold or for which you request a valuation. You must act in your own capacity and not as a representative or agent of another individual. We reserve the right to request proof of ownership before completing any transaction.

 

By using our service you guarantee all of the following: that no items sent to us are the result of illegal activity in the UK or any other country; that any transaction initiated by the customer will not cause us to be in violation of any anti-money laundering, anti-terrorism, or other applicable law of any country; not to send any hazardous material to us and not to send us any material that does not contain precious metals.

 

Posting and Insurance 

 

All items sent to us must be posted using the Royal Mail Special Delivery pack that we have provided to you.  This ensures your items are insured for up to £750 whilst in transit to our valuation centre.  All items posted to us are at your own risk until received and signed for by our valuation centre.  If you believe your items may be worth more than £750, you must pay an additional fee at the Post Office to increase the insurance level.  Our liability is limited to £750.You must enter the quantities of the items you are sending us within the declaration form included within your pack. We reserve the right to reject any forms (and the items they are sent with) which are not properly completed and signed.  We also reserve the right to reject delivery of any package which appears to be opened, damaged, or tampered with in any way. Any such packages we reject will be returned to you – at our cost – but without any liability to us.

 

Valuation Process 

 

Once your items have been received at our valuation centre, they will be tested by placing acids on the items.  In addition, we may need to break your items in order to check if they are solid or simply wrapped in a precious metal.  You accept that this process of determining a value can leave permanent staining and damage to your items.  You agree that we are not liable for any damage caused in this way or any resulting decrease in the value of the items. We are not able to return any stones that are left in your items.  If you wish to keep any stones, then they need to be removed by you before they are sent to us.  Where our valuers find a significant Gemstone, which does have intrinsic value, this will be considered when an offer is made.

 

Price Match

 

We will match any price that has been offered to you by other online gold buyers.  For this price match to apply we will require a copy of the offer that has been made to you.  The offer must contain a detailed description of all items that the offer has been made on including the weight of the item, grade of metal, price offered and date of the offer.  This price match only applies to scrap gold.  It does not apply to jewellery being sold for resale or bullion bars or coins.  The offer must have been made in the past 14 days.  Our offer will also take into account any movement in the gold market.  For example, if the gold fix has dropped by 5% since the original offer was made our offer will be 5% lower.

 

How We Pay for Your Goods

 

Following receipt of your pack, our valuation centre will conduct various tests and we will contact you via email and or SMS with an offer to purchase your items.  Following your acceptance, we will request your bank account details.  On receipt of your payment details, and declaration of acceptance, we will make payment to you by way of Faster Payment directly to your UK bank account within 2 working days. There is no charge for this service. Once you have accepted our offer, the goods can be immediately smelted, so your acceptance is legally binding on both you and us and it is irrevocable.  Please note that when accepting an offer, any no value items will not be automatically returned.

 

Rejecting Our Offer & Returns 

 

If you decide not to accept our offer for your items your goods will be returned to you – at our cost, via Royal Mail Special Delivery within five (5) working days from when you declined our offer. However, if you send items containing no precious metals, there is a £25 fee for returning them, or we can dispose of them free of charge.  Your payment must be received within 28 days or the items will be disposed of.

 

If returned items are not able to be delivered by the Royal Mail because they have been unable to obtain a signature, they will leave an instruction card.  If the package is returned to a local delivery office, it will need to be collected within a period specified by the Royal Mail.  If, however the package is not collected within this time, it will be returned to us. On receipt of the returned items we will contact you to arrange for the items to be resent; however, there will be a charge of £25 to cover the additional postage and administration costs.

 

Returns Loss Liabilities

 

In the unlikely event that any of your items are lost once we have received them, we will pay you their replacement value, or provide items of a near equivalent value.  If you are not happy with the near equivalent items we provide, we will jointly appoint, and jointly pay for, an independent valuer to assess them and we will both be bound by their judgment.

 

Lost Property 

 

If items are sent to us without a completed declaration form it is unlikely, we will be able to identify the sender unless the name and address has been written on the Special Delivery pack.  If the pack was requested via our website; we may be able to identify the sender using the special delivery reference number.  If, however we are not able to identify the sender then the items will be classed as lost property.

 

We will continue to hold these items for a period of 3 months in a secure area.  In order to claim any lost items you will be required to provide a full and detailed description.  Once we have confirmed a successful lost property claim, we will make an offer for the items at our current price.  If the items have been held in excess of 6 weeks, a deduction will be made from this payment to cover our storage and administration costs.

 

If a claim is not made within 3 months the items will be refined to recover our storage and insurance costs of £15 per week.  If a claim is made after the items have been refined, a payment will be made for any outstanding amount due. Our Special Delivery packs are coded with a unique license and are for customers sending precious metal with the intent to sell.  If you use our Special Delivery envelope to send items intended for someone else – they will be sent to us.  The fee for returning these items is £25, this covers our postage, insurance and administration costs.


Indemnification

You agree to indemnify us against all liabilities, claims, losses, costs and fees which we incur as a result of any breach by you of these terms (including, but not limited to, claims brought by third parties).


Complaints

We will always aim to provide an exceptional service.  However, if at any time you become unhappy with our service we are committed to resolving your complaint as quickly as possible.  In the event that you wish to make a complaint please contact us by emailing

Governing Laws

These terms shall be governed by the courts and laws of England and Wales and all parties consent to the exclusive jurisdiction of the English courts to settle any dispute or claim arising.


Data Protection

We take your rights to privacy very seriously.  All personal information that we may collect and hold will be collected, used and held in accordance with the provisions of the Data Protection act 1998.  For your part, you agree to the storing of this data for the provision of the services that we have agreed to undertake.


Other 

We reserve the right to assign our rights and responsibilities under this contract to a third party for example, if we sell our business.  In this event you will be informed by us in writing.
